TERMS AND CONDITIONS

1. BOOKINGS, PAYMENTS AND CANCELLATIONS​

  • Quotes Issued - All quotes issued by Foxy The Kombi are strictly valid for 7 days and include GST.  Expired quotes need to be reconfirmed e.g: cost and availability of Foxy The Kombi. Prices quoted are based on the duration of hire and the locations as detailed in your initial inquiry. Changes to your itinerary including pick up locations may affect the original quoted price.

  • Tentative Bookings – Foxy The Kombi will be able to tentatively book the vehicle for 48 hours while clients finalise event details.  After this time frame has expired, and if no confirmed booking has been made, the vehicle will automatically be made available for other potential clients to book.

  • Secure your Booking - In order to secure a booking, Foxy The Kombi requires a non-refundable deposit payment of 30% (calculated by the total package value), payable within 7 days of booking. Deposits paid are non-refundable. When securing your booking, along with the deposit you must also sign and return the terms and conditions and invoice supplied by Foxy The Kombi. Once both the deposit and terms and conditions have been returned, your booking will be confirmed.

  •  Outstanding Balance – Foxy The Kombi requires all outstanding balances to be paid in full 4 weeks prior to the booked date. Should payments not be received within this timeframe, Foxy The Kombi reserves the right to cancel the booking.

  • Cancellations – All cancellations must be notified in writing. Please consider our Terms and Conditions of service prior to booking with us. All cancellations will forfeit the deposit payment whether it be change of mind, event cancellations, hazardous weather conditions (Act of God), Act of Government closures, illness, death in family. Bookings and payments are non-transferable to another person.

  • Early Termination of Booking - in the event a client terminates the booking early the following fees will apply.

  • More than 6 months prior to the booked date, the 30% deposit payment (non-refundable) will be absorbed by Foxy The Kombi. All other payments will be refunded.

  • 6 months or less from the booked date, additional to the deposit payment, a further 30% of the full balance will either be held or charged

  • 3 months or less from the booked date, additional to the deposit payment, a further 50% of the full balance will either be held or charged

  • 3 weeks out from the booked date, full quoted price will either be held or charged.

  • Postponement of Date - We are happy to offer a flexible change of date policy. Please check-in with us to confirm if Foxy The Kombi is available for your preferred new date and to ensure we can fulfill your request.  Should you decide to postpone your event to a date we are unable to fulfill, your deposit payment will not be refunded as we would have held your original date with other booking enquiries declined on this date.  If you are unsure of your new date, we are happy to hold your deposit payment for 6-months whilst you decide. Foxy The Kombi requires the terms and conditions and invoice to be signed when dates are changed from original booking.

  • Additional Time Required - In the event Foxy The Kombi is required beyond the designated time-frames, an additional fee of  $60.00 per 30 minutes and $100.00 per hour (or part thereof) will apply. All outstanding money is due for payment within 24 hours from booked event date.  Payments received past this timeframe will incur an additional 10% late fee charge on all outstanding money.

  • We Cancel a Booking – In the event Foxy The Kombi needs to cancel a booking, all monies paid to date will be refunded to the client(s) within 30 days.

  • Full payment not received – Foxy The Kombi reserves the right to cancel the booking if all outstanding balances are not paid 4 weeks prior to booked date as part of the agreement. Due dates stated on Tax Invoices.

  • We will take last minute hire bookings and payments right up to the day before the date required if the vehicle is available.

  • There is no refund for unused services or time

  • It is the responsibility of the hirer to be aware of the service time booked and to allow adequate travel time between locations.

  • The time booked starts from the agreed start time

  • We aim to arrive approximately 10-15 minutes prior to the pick-up time but this is not guaranteed due to unexpected traffic delays.

  • Foxy The Kombi is hired for a minimum period of 3 hours, rates start at time of pick-up and price applies from pick-up time to drop-off.

  • Foxy The Kombi will not be held responsible for client(s) who supply incorrect information on forms. Misleading information for destination addresses, could incur additional charges. Booking will be subject for review.

  • Travel beyond the 25 km Melbourne City limit will incur an additional travel cost for petrol and dependent on location.

 

2. GENERAL CONDITIONS 

  • You, the hirer also carry responsibility as to the care and welfare of your passengers and to Foxy The Kombi. You, the hirer recognises and understand there are limitations to a vintage car. By making a booking and paying a deposit, you understand, accept and agree to these conditions: -  

  • Kombis do not have fitted air-conditioning however we have purchased a solo air conditioning unit that will sit near the driver facing the passengers.

  • No sitting, leaning, kneeling or standing on front or rear bonnets, bumper bars or roof /retractable roof tops. No standing on seats. This extends to photo’s sessions.

  • It is illegal for Foxy The Kombi to seat more passengers then what the vehicle(s) is registered for.

  • All passengers are required by law to wear seat belts (where fitted) at all times while Foxy is moving.

  • Children under 12 years of age must be accompanied by an adult in Foxy.

  • Children between 4 to 7 years of age are legally required to be seated in a booster seat. We request that you provide suitable car seats for all children under the age of 7. Where we can, our chauffeur will fit the seat into the Kombi for you.

  • All booster seats used in Foxy The Kombi must be free standing seats. No anchor fitted seats are to be used.

  • Children under 4 years of age are not permitted to travel in Foxy.

  • We do not provide booster seats for Foxy The Kombi unless agreed at the time of the booking.

  • The client agrees to keep confidential the quoted prices, intellectual property and any other information issued either verbally or written.

  • Passengers limited to small carryon bags as Foxy The Kombi has limited boot space.

  • Foxy The Kombi will not be driven on certain surfaces eg: dirt roads, broken roads, sand, gravel etc. Should client(s) insist Foxy be driven over driveways and damage is sustained to Foxy, client(s) will be held financially responsible for all repairs. Foxy The Kombi reserves the right to refuse to drive on such surfaces. It is the client responsibility to disclose 14 days prior to hire date if Foxy The Kombi will be required to travel on unsealed roads.

  • Foxy The Kombi must be notified in writing of any medical conditions of passengers prior to booked date.

  • No pets allowed in Foxy The Kombi.

  • No smoking is permitted in Foxy The Kombi.

  • Fruits Juice, Coffee/Tea/Hot Chocolate, bubble-gum/sticky lollies are not permitted to be consumed in Foxy.

  • At no point do we allow prohibited substances to be consumed or stored in Foxy.

  • Intoxicated, drug effected, violent or abusive passengers will be refused entry into Foxy The Kombi. These passengers will need to make their own arrangements and Foxy The Kombi will not be held financially liable.

  • Deodorants, tanning or hair sprays are not to be sprayed in Foxy.

  • Foxy The Kombi is to be driven by our staff only. 

  • Foxy The Kombi will take no responsibility for items left behind in the vehicle.  Arrangements will need to be made by the client(s) to collect items from our office in person as we do not post items out.  Items will need to be collected within 14 days from booked date, once this timeframe has lapsed no further reminders will be issued and items will be disposed.

  • Our insurance does not cover the following, loss or damage to client(s) possessions, delays or missed events. Foxy The Kombi will not be held financially liable.

  • All set downs, pick-ups and photo’s shoots will be made in legal stopping zones. Foxy The Kombi will not be held financially liable in the event fines are issued. These fines will need to be paid in full by the client(s).

  • Foxy The Kombi reserve the right to take photos and videos of the wedding party for promotional purpose eg: social media, website, brochures, expo etc.

  • Foxy The Kombi reserves the right to charge cleaning fees should Foxy sustain the following: spills, excessive mud, sand or road base.  Professional cleaning ranges from $100 to $500 depending on the stain and time spent cleaning.

  • No additional paraphernalia will be attached to Foxy including but not limited to, tin cans, items attached by string, adhesives, flowers, sign etc. 

  • In the event client(s), bridal party, guests or contractors sustain an injury either inside or around Foxy, Foxy The Kombi, drivers or the owners of vehicle(s) will not be held legally liable or financially responsible for any injury or wrongful death.   
     

3. PHOTOGRAPHERS/VIDEOGRAPHERS

  • No Photographers/ Videographers are permitted to travel from point to point in Foxy The Kombi. They will be required to make their own way from point to point.

  • Foxy The Kombi will not store photographic equipment/ Videographers equipment footage in the vehicle.

  • The client(s) will be held financially accountable for all repairs for any damage sustained to Foxy by Photographers/ Videographers.
     

4. DAMAGE TO FOXY THE KOMBI PROPERTY

  • Should any damage be sustained to Foxy either internally or externally by either the client(s), client(s) guest, bridal party, photographer or videographers, client(s) will be held financially responsible for the repairs / replacement of parts.  Any expenses incurred gaining quotes for repairs will be passed to client(s) for payment.

  • In the event vehicle(s) repairs impact other bookings, client(s) may be held financially responsible for refunds applied to other client(s). 
     

5. BREAKDOWNS

  • In the event Foxy breakdowns in transit, Foxy The Kombi will not be held legally or financially liable.

  • Foxy The Kombi will not be held legally or financially liable, for any loss of time, delays or missed events.

  • Foxy The Kombi will do their best to arrange another vehicle(s) but cannot guarantee a successful swap out with the same make, model or colour as these are vintage vehicle(s).

  • In the event Foxy The Kombi are unable to successfully swap out vehicle(s) due to time restrictions or vehicle(s) availability, a pro-rata will be calculated from the time of the breakdown to the finish time and offered as a refund back to the client(s).

  • If the above point has been applied, Foxy The Kombi will book in an Uber to move passengers from point to point within the booked times.  The Uber charge will be paid by Foxy The Kombi.

 

6. COMPLAINTS, VALIDATIONS, AMENDENTS 

  • All complaints need to be raised at the time of the booking in writing and emailed to foxythekombi@gmail.com. Foxy The Kombi will address the complaint on an individual-bases and will endeavour to address the complaint in a timely manner in the form of a written response.

  • As a formality Foxy The Kombi requires the terms and conditions to be completed, signed and emailed back to us at the time of a booking. By paying the reservation fee it is deemed that you have accepted without exclusion our terms and conditions.

  • Foxy The Kombi reserves the right to cancel a booking should the terms and conditions not be completed and emailed back at the time of booking.  

  • Client(s) are responsible to disclose these terms and conditions to all parties who will be using the services.

  • Amendments – Foxy The Kombi reserves the right to change or amend our policies, terms and conditions without written approval.

  • Last minute changes or requests to a booking must be requested in writing no later than 14 days prior to booked date. All requests will be subject for review and confirmation by Foxy The Kombi.

  • All agreements made must be in writing. Verbal agreements will not be accepted by Foxy The Kombi. 

 

7. FORCE MAJEURE

  • There could be circumstances beyond our/your control, an unforeseen event, which may impede our ability to service your booking; or require you to change your wedding day/event. This might include (but is not limited to) fire, flood, storms, high winds or cyclones, an earthquake, lightning, explosion, strikes, lockouts, epidemics, pandemics, plagues, energy shortages and state or government action and mandates.

  • During these uncertain times, we will do everything we can to help you. If you decide to reschedule your day, we will transfer any monies paid to your new date. There is no fee to do this if the booking details remain the same. Bookings are subject to availability. For each subsequent change of date, an administration fee of $200 is applied.

 

8. COVID19 SAFETY: Please help us keep you safe

  • The number of passengers we are permitted to carry can change at any time, without notice, due to government regulations.

  • We can accept pre-paid, contactless payment only.

  • We are required by the VIC Government to document the names and telephone numbers for all passengers travelling in Foxy The Kombi. This information is stored confidentially and only used, if required, for the purposes of tracing COVID19 infections.

  • If any of your passengers are feeling unwell, we request they make alternative transport arrangements so the potential spread of any contagion can be minimised.

  • VIC Health strongly recommend masks are worn for passengers using point to point transport vehicles. Although the use of masks is not currently mandatory, it is recommended. Your driver will wear a mask on the day.

  • Whilst driving, we ask the windows of Foxy are left open to increase the air flow

  • Available for your use, Foxy will be equipped with liquid hand sanitiser gel and disinfectant wipes.

  • For your peace of mind, before every wedding, Foxy The Kombi will be washed & cleaned so she looks beautiful & sparkling but we have employed heightened sanitation methods as part of our COVID19 Safety Plan. Foxy will be sanitised before, during and at the end of each wedding including wiping all surfaces including door handles, seating and seat-belts with an alcohol based disinfectant.
